CupcakePass, Inc. ("CupcakePass," "we," "us," or "our") provides a subscription-based platform for food and beverage purchases and related services. This Privacy Policy explains how we collect, use, retain, disclose, and protect information when you access or use www.cupcakepass.com, create an account, purchase a subscription or gift plan, or otherwise interact with our services (collectively, the "Service").
By accessing or using the Service, you acknowledge that you have read and understood this Privacy Policy and agree to the collection, use, retention, and disclosure of information as described herein. If you do not agree with this Privacy Policy, you should discontinue use of the Service.
A. Information You Provide Directly. We may collect personal information you voluntarily provide, including but not limited to: full legal name, email address, phone number, billing and mailing address, account credentials, subscription and plan details, communications with customer support, and any other information you choose to provide.
B. Identity Verification (KYC) and Risk Data. To comply with legal, financial, fraud-prevention, and platform-integrity requirements, we may collect or receive identity-related information, including government-issued identification, date of birth, identity verification results, and fraud and risk indicators. Identity verification may be conducted directly by CupcakePass or through third-party providers and may be required to access certain features of the Service.
C. Automatically Collected Information. When you access or use the Service, we may automatically collect information such as IP address, device identifiers, browser type and operating system, approximate location and time zone, log files, timestamps, usage data, and pages viewed and interactions with the Service. This information is collected for security, analytics, fraud prevention, dispute resolution, and operational purposes.
D. Transaction and Platform Activity Data. We collect information related to your use of the Service, including credit issuance, usage, burns, and penalties; virtual or physical card issuance and usage; order attempts and confirmations; receipt uploads or failures; and subscription renewals, cancellations, and billing events.
We may use collected information for any lawful business purpose, including but not limited to: operating, maintaining, and improving the Service; processing subscriptions, payments, and renewals; issuing and managing credits and cards; identity verification and fraud prevention; risk management and platform integrity; enforcing our Terms of Service and other policies; chargeback, dispute, and fraud defense; customer support and communications; marketing, promotional, and informational communications; analytics, research, and product development; and compliance with legal and regulatory obligations.
If you provide your mobile phone number to CupcakePass, you expressly consent to receive transactional and account-related text messages from CupcakePass. These messages may include account verification, subscription status updates, order confirmations, service notifications, security alerts, and customer support responses. Text messages are sent only to users who have explicitly opted in. Message frequency varies. Message and data rates may apply. To the maximum extent permitted by applicable law, CupcakePass retains personal information indefinitely, including after account closure, subscription cancellation, or inactivity, for purposes including legal and regulatory compliance, fraud prevention and detection, risk management, dispute, arbitration, and chargeback defense, enforcement of agreements, and business continuity, analytics, and recordkeeping. You acknowledge that requests to delete personal information may be denied where retention is lawful, necessary, or legitimate.
To the maximum extent permitted by law, CupcakePass may share, disclose, license, or otherwise make available your information to: payment processors and financial partners (including Stripe); identity verification and fraud-prevention providers; card networks and issuing banks; cloud hosting and infrastructure providers; analytics, logging, monitoring, and attribution services; marketing, advertising, and promotional partners; business partners, affiliates, contractors, and service providers; legal, regulatory, arbitration, or law-enforcement authorities; and actual or potential acquirers, investors, successors, or assignees. Once information is lawfully shared with third parties acting independently, CupcakePass does not control their use of such information.
Information may be shared with Stripe, card networks, issuing banks, and related entities for purposes including payment processing, fraud prevention and monitoring, and chargeback and dispute resolution. Shared information may include identity verification status, IP addresses, device data, transaction history, receipt logs, and records of acceptance of our Terms and policies.
CupcakePass uses cookies, pixels, SDKs, and similar technologies to operate and secure the Service, authenticate users and maintain sessions, prevent fraud and abuse, analyze usage and performance, improve functionality and reliability, and attribute marketing and promotional activity. By continuing to access or use the Service, you consent to our use of cookies and similar technologies. You may disable cookies through your browser settings, but doing so may limit functionality.
We implement reasonable administrative, technical, and organizational safeguards to protect information. However, no system is completely secure and internet transmission involves inherent risk. CupcakePass does not respond to browser "Do Not Track" signals.
The Service may contain links to third-party websites or services. CupcakePass is not responsible for their privacy practices or content.
